Fintology Financial

Fintology Financial Terms of Service

Effective date: October 17, 2026 · Last updated: October 17, 2026 · Fintology AI Technologies LLC

Please read this document carefully. It is a legally binding agreement.

Fintology Financial is not a bank. Fintology AI Technologies LLC is a technology company. It is not a bank, credit union, money transmitter, lender, broker-dealer or investment adviser, and it does not hold, control or transmit your money. Account, transfer and payout services are provided by our payments infrastructure partner and its financial institution partners; the Fintology Financial Visa card is issued by a licensed card issuer under license from Visa. Your balance is held as US dollar–backed stablecoins in a digital wallet that is yours. It is not a bank deposit, it is not insured by the Federal Deposit Insurance Corporation (FDIC), the National Credit Union Administration (NCUA) or any other government agency, and it does not earn interest. Section 20 contains a binding arbitration clause and a class action waiver that affect your legal rights.

1. Who we are and what this agreement covers

These Terms of Service (the "Terms") are a legally binding agreement between you ("you", "your", the "Customer") and Fintology AI Technologies LLC, a Georgia limited liability company, also known as Fintology AI LLC, Fintology LLC and Fintology Technologies LLC ("Fintology", "we", "us", "our"), with its mailing address at 1700 Northside Dr NW, Ste A7 #917, Atlanta, GA 30318, United States.

They govern your use of Fintology Financial: the website at deposits.fintology.ai and its pages (the "Site"), the Fintology Financial application for phone, tablet and desktop (the "App"), every Fintology Financial account, balance, card, transfer, payout, payment link, reward and related feature, and any Fintology Financial service offered inside a partner's portal or at a Fintology Money Center (together, the "Service").

Fintology Financial is a separate product from the Fintology funding software platform used by brokers, advisors and their clients. Your use of that platform is governed by the Fintology Terms & Conditions at fintology.ai/terms, which also contain a section on Fintology Financial. Where these Terms and that document differ about a Fintology Financial account, these Terms govern.

When you open an account you will also be shown, and must accept, the account agreement, wallet terms, cardholder agreement and privacy terms of the licensed partners who provide the regulated parts of the Service (the "Partner Agreements"). The Partner Agreements govern your relationship with those partners. Where these Terms and a Partner Agreement differ about a service that partner provides, the Partner Agreement governs that service.

By visiting the Site, joining the launch list, opening an account, adding money, using a card, or otherwise using the Service, you agree to these Terms, to our Privacy Policy and to our E-Sign Consent. If you do not agree, do not use the Service.

2. Definitions

3. Not a bank: how Fintology Financial works

Fintology writes the software: the Site, the App, the screens, the ledger that records your activity, the receipts, the statements and the customer support. Every regulated part of the Service is performed by a licensed partner:

WhatWho does itWhat that means for you
Your BalanceA stablecoin issuer holds the reserves; your Wallet holds the coinsNot a bank deposit. Not FDIC or NCUA insured. No interest.
Your WalletOur wallet partner, with youThe Wallet is yours. Fintology does not hold, control or transmit your funds.
Dollars in and out (ACH, wire, card top-ups)The Payments Partner and its financial institution partnersYour account and routing details, and every transfer to or from a bank account, run on their rails under their rules.
Your CardThe Card Issuer, under license from VisaThe Card is a secured line of credit from the Card Issuer, backed by your Balance. Fintology is not the lender and does not extend credit.
Identity and business checksThe Payments Partner and the Card IssuerThey collect and hold your identity documents under their own privacy terms.
RewardsFintology, with merchants and offer networksRewards are promotional. Fintology may receive commissions from the merchants and networks that fund them.

Fintology is not a lender, loan broker, financial advisor, credit counselor or credit repair organization. Nothing on the Site or in the App is financial, legal, tax or investment advice. The names, status and regulatory standing of our partners are set out in the Partner Agreements and on the Site's disclosures page; until our programs are approved by those partners, the Site refers to them generically.

4. Eligibility and your account

4.1 Who may open an account

4.2 Your login and your duty to protect it

You are responsible for everything done through your login. Keep your phone, passcodes, passkeys and one-time codes private. Tell us at once at support@fintology.ai or +1 (800) 448-1103 if you believe someone else has used your Account. Until you tell us, you are responsible for authorized use of your login as the Partner Agreements and applicable law allow.

4.3 Accurate information

Everything you tell us, including your name, date of birth, address, business details and ownership, must be true, complete and kept current. We and our partners may suspend or close an Account opened with false information, and may be required by law to report it.

5. Identity and business verification

To open or keep an Account, you (and, for a business, the business and each beneficial owner) must pass the identity and business verification run by our partners, including document checks, a selfie match and checks against government and sanctions lists. Our partners may ask for more information at any time, decline an application, or limit, suspend or close an Account where the law, their program rules or a risk review require it. For Fintology Financial, identity verification is performed by our partners: Fintology does not collect or store your Social Security number, date of birth or identity documents for it. Our partners do, under their own privacy terms.

We may also run our own fraud and risk checks on the information you give us, on your device and on your activity.

6. Your balance: stablecoins, your wallet, and what we do not do

6.1 What your balance is

Money you add to Fintology Financial is converted by our partners into US dollar–backed stablecoins and recorded as your Balance. Your Balance is held in a Wallet that is yours. When you spend, send or cash out, our partners convert or move those stablecoins on your instruction. The App shows your Balance in US dollars for convenience.

6.2 What it is not

Your balance is not a bank deposit. It is not insured by the FDIC, the NCUA or any other government agency. It does not earn interest. Fintology is not a bank, does not take deposits, and does not hold, control or transmit your funds.

6.3 Stablecoin risk

A stablecoin is designed to keep a value of one US dollar but it is not legal tender and is not guaranteed by any government. Its value, or your ability to move it, can be affected by its issuer, the blockchain networks it runs on, network congestion or outages, changes in law, or our partners' services. In rare cases a stablecoin may trade below one dollar. We do not guarantee the value of, or your access to, any Balance at all times. You accept these risks when you use the Service.

6.4 Where we say "deposit"

Where the Site or App uses the words "deposit", "deposit with us" or "deposit details", they mean adding money to your Fintology Financial Balance or the account and routing details used to send money to it. They do not mean opening a deposit account at a bank, and no bank account is opened in your name by Fintology.

6.5 Yield

We do not pay interest or yield on balances, and we do not offer staking or yield products.

7. Adding money

You may add money to your Account by the methods shown in the App, which may include an ACH or wire transfer to the account and routing details given to you, a debit card, a saved payment card (business accounts), or a supported digital asset. Each method has its own timing, limits and fees, shown before you confirm. Money is credited to your Balance only when our partners have received and settled it. A transfer that is reversed, returned or charged back after it was credited is deducted from your Balance, and you owe us any shortfall. Your account and routing details are provided by our Payments Partner; we do not guarantee that they are permanent, and we will tell you if they change.

8. Moving money: transfers, payouts, payment links and requests

8.1 What you can do

8.2 Rules for every transfer

8.3 Fincash

Fincash, the send-and-request feature shown on the Site as "coming soon", is not available. It launches only if and when our partners approve it, and it will be governed by terms shown at that time.

9. Fees

Every fee, and the total, is shown to you before you confirm a transaction. Fees charged by our partners (for example for an instant payout, a wire or an international transfer) are passed through to you. Fintology may add its own fee to a transaction; when it does, that fee is shown separately, and both are shown before you confirm. Card purchases carry no Fintology fee at launch. A current fee schedule is on the Fees page of the Site; where a fee is marked "to confirm" it has not been set, and nothing is charged for it until it is shown in the App. We will give you at least 30 days' notice before introducing a new fee or increasing an existing one, by the methods in Section 21. Fees are deducted from your Balance. Third parties (your bank, a card network, a receiving bank, a currency conversion) may charge their own fees, which we do not control.

10. The Fintology Financial Visa card

10.1 What the card is

The Fintology Financial Visa card is a virtual card issued by the Card Issuer under license from Visa. It is a secured line of credit: the Card Issuer extends credit to you, secured by your Balance, and each purchase is repaid from your Balance. Fintology is not the lender and does not extend credit; the Card Issuer is the creditor. Your card limit follows your Balance and any limits you or the Account owner set. If a payment is not made, the Card Issuer may use your Balance to cover it, as the cardholder agreement provides.

10.2 Applying and using the card

10.3 Card disputes

Disputes about card purchases (an unrecognized charge, goods not received, a wrong amount) are handled under the Card Issuer's cardholder agreement and the Visa network rules. Start a dispute from the transaction in the App or by contacting us; we will route it to the Card Issuer and keep you informed.

11. Teammate cards and authorized users

A business Account owner may invite teammates and give each a card with its own spending limit. Teammates complete identity verification with our partners before a card is issued. The Account owner is responsible for every teammate's use of the Account and cards, for setting and reviewing limits, for removing teammates who leave, and for the teammates' compliance with these Terms and the Partner Agreements. A teammate sees only their own card and activity. The owner cannot see a teammate's full card number, CVC or PIN.

12. Rewards, cash back, deals and goals

13. Partners who offer Fintology Financial, and white-label issuing

A Partner on the Fintology funding platform whose plan includes it may offer Fintology Financial to its clients, inside the Partner's portal. If you opened your Account through a Partner:

14. Fintology Money Centers and in-person services

Where Fintology operates a Money Center or other physical location, every cash, check or ATM service there is performed by a licensed partner (a cash-load network, a licensed check casher, an ATM operator). Fintology's staff run the screens, the receipts and the ledger entries; Fintology does not itself receive, hold or disburse cash. Each in-person service has its own partner terms, limits and fees, shown before you confirm. A check is credited to your Balance only when the licensed partner releases cleared funds. A Money Center is not a bank branch and has no tellers.

15. Your information, lender matching and consent

Our Privacy Policy explains what we collect, how we use it and your choices. In addition:

16. Errors, unauthorized activity and disputes

16.1 Tell us at once

Review your activity and statements promptly. If you see a transaction you did not make or authorize, a transfer that is wrong or missing, or any error, tell us as soon as you can and no later than 60 days after the statement or activity entry showing it first appears, at support@fintology.ai, by phone at +1 (800) 448-1103, or from the transaction in the App. Tell us your name and Account, the transaction, the amount and why you believe it is wrong.

16.2 What happens next

We will investigate with our partners and tell you the result. Our partners' agreements, the Visa network rules and applicable law (including, where it applies, the Electronic Fund Transfer Act and Regulation E for consumer accounts) set the investigation timelines, when a provisional credit is given, and the extent of your liability for unauthorized transfers. Your liability for unauthorized card use is limited as the cardholder agreement and Visa's zero-liability policy provide. Telling us late may limit what can be recovered.

16.3 Transfers you authorized

A transfer you authorized to a recipient you chose, including to a wrong recipient or in a wrong amount you entered, is not an error or unauthorized transfer. We will try to help you recover it, but we cannot guarantee recovery.

17. Acceptable use and prohibited activity

You may use the Service only for lawful purposes, for yourself or your verified business, in the United States. You agree not to use the Service, and we and our partners may refuse any transaction or close any Account used, for or in connection with:

18. Our rights: holds, limits, suspension and closure

We and our partners may, acting reasonably and as the law and the Partner Agreements allow: set and change transaction limits; hold, review, delay or decline a transaction; freeze a card; require more information; suspend or restrict an Account while a review is open; and close an Account. Reasons include a legal or regulatory requirement, a partner's program rules, suspected fraud or unauthorized use, a breach of these Terms, a risk to you, us or others, or inactivity. Where the law allows, we will tell you why and how to respond. If an Account is closed, any Balance is returned to you by a method we support, less any amounts you owe, as the law allows, after any required hold. You may close your Account at any time after cashing out your Balance; cancelling any outstanding card balance and resolving open disputes first.

19. Disclaimers, limitation of liability and indemnity

19.1 Disclaimers

The Site, the App and the Service are provided "as is" and "as available". To the fullest extent the law allows, Fintology disclaims every warranty, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure, or available at any particular time.

Fintology does not guarantee the value of any stablecoin, the timing of any transfer, the approval of any card application, the availability of any reward, or the acts or omissions of any partner, bank, card network, merchant, blockchain network or other third party.

19.2 Limitation of liability

To the fullest extent the law allows, Fintology, its members, managers, officers, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of profits, revenue, business, goodwill or data, arising out of or relating to the Service or these Terms, however caused and under any theory of liability, even if advised of the possibility. To the fullest extent the law allows, Fintology's total liability for all claims arising out of or relating to the Service or these Terms in any twelve-month period will not exceed the greater of (a) the Fintology fees you paid us in that period and (b) one hundred US dollars ($100).

Some states do not allow some of these limitations, so some may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, including your rights under Regulation E or the cardholder agreement for unauthorized transactions.

19.3 Indemnity

You agree to defend, indemnify and hold harmless Fintology and its partners from any claim, loss, liability, cost or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Service, your violation of any law or third-party right, or any transaction you authorize.

20. Dispute resolution: binding arbitration and class action waiver

Please read this section carefully. It requires you to arbitrate disputes with Fintology individually and waives your right to a jury trial and to participate in a class action.

20.1 Talk to us first

Before starting arbitration or a court case, you agree to contact us at support@fintology.ai or the mailing address in Section 26 with a written description of the dispute and what you want, and to give us 60 days to try to resolve it with you informally.

20.2 Agreement to arbitrate

Any dispute, claim or controversy between you and Fintology arising out of or relating to these Terms, the Site, the App or the Service, including its existence, validity, interpretation or termination, and whether based in contract, tort, statute or any other theory (a "Dispute"), will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or Commercial Arbitration Rules for business Accounts) then in effect, except as modified here. The Federal Arbitration Act governs this section. The arbitrator decides all issues, including the scope and enforceability of this agreement to arbitrate, except that a court decides whether the class action waiver is enforceable.

20.3 How arbitration works

20.4 Class action waiver

You and Fintology agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding. If this class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be heard in court, and the rest of this section still applies.

20.5 Exceptions

Either party may bring an individual claim in small claims court if it qualifies, and either party may seek an injunction in court to protect its intellectual property or to stop unauthorized use of the Service. Nothing in this section prevents you from bringing a complaint to a government agency.

20.6 Your right to opt out

You may opt out of this agreement to arbitrate by sending written notice, within 30 days after you first accept these Terms, to Fintology AI Technologies LLC, Attn: Legal, 1700 Northside Dr NW, Ste A7 #917, Atlanta, GA 30318, or to support@fintology.ai with the subject "Arbitration opt-out", stating your name, the email on your Account and that you opt out of arbitration. Opting out does not affect any other part of these Terms.

20.7 Jury trial waiver

Where a Dispute is heard in court rather than arbitration, you and Fintology each waive any right to a trial by jury to the fullest extent the law allows.

21. Electronic communications, notices and changes to these Terms

By using the Service you consent to receive all communications, agreements, disclosures, statements, receipts and notices electronically, as described in our E-Sign Consent, which is part of these Terms. We may give you notice by email to the address on your Account, by a message or notice in the App, or by posting on the Site. You must keep your email address and phone number current.

We may change these Terms. If a change is material, we will give you at least 30 days' notice before it takes effect (or shorter notice where the law requires or a partner's program change requires), by the methods above. The current Terms, with their effective date, are always at deposits.fintology.ai/legal/terms.html, and earlier versions are available on request. Your continued use of the Service after a change takes effect is your acceptance of it. If you do not agree, cash out your Balance and close your Account before the change takes effect.

22. Intellectual property and the website

The Site, the App, their design, text, graphics, screens, software and the Fintology, Fintology Financial, Fintology Issuing, Fincash and Fintology Money Center names and marks are owned by Fintology or its licensors and protected by copyright, trademark and other laws. You receive a limited, personal, non-exclusive, non-transferable, revocable license to use the Site and the App to use the Service. You may not copy, modify, distribute, sell, lease, reverse engineer or create derivative works of any part of them, or use any mark without our written permission. Visa is a trademark of Visa International Service Association; Apple Pay and Google Pay are trademarks of their owners. Sample balances, names and transactions shown on the Site are examples, marked as such, and are not real accounts.

If you give us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without obligation to you.

23. Coming-soon features, beta features and the launch list

Fintology Financial is being prepared for launch. Features, fees, availability, partners and timing described on the Site may change before or after launch, and nothing on the Site is an offer to open an account until one is made available to you in the App. Features marked "coming soon" (including Fincash) launch only if and when our partners approve them. Features marked "beta" or "preview" may be changed or withdrawn at any time. By joining the launch list you agree that we may email you about the launch; you can unsubscribe at any time using the link in any email or by writing to support@fintology.ai, and we will send you nothing else.

24. Governing law, complaints and regulators

These Terms are governed by the laws of the State of Georgia and the federal laws of the United States, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs Section 20. Subject to Section 20, the state and federal courts located in Fulton County, Georgia, have exclusive jurisdiction over any Dispute heard in court, and you consent to their jurisdiction.

If you have a complaint, please contact us first (Section 26); we aim to acknowledge every complaint within one Business Day and resolve it promptly. You may also contact the licensed partner identified in your Partner Agreements about the service it provides. Consumers may contact the Consumer Financial Protection Bureau at consumerfinance.gov or 1-855-411-2372, and may have rights under the laws of their state of residence, including the right to complain to their state's financial regulator.
