Consent to Electronic Communications and Signatures
Fintology Financial is an online service. To open and keep an account you must agree to receive your agreements, disclosures, statements, receipts and notices electronically, and to sign electronically. This consent explains what that means, what you need, and how to withdraw it. Please read it and keep a copy. It is part of the Terms of Service.
1. What you are agreeing to
By accepting this consent (by ticking the box, tapping "I agree" or continuing to open an account) you agree that Fintology AI Technologies LLC ("Fintology", "we") and, where they rely on this consent, the licensed partners who provide parts of Fintology Financial, may provide you with the following in electronic form rather than on paper (together, "Communications"):
- the Terms of Service, the Privacy Policy, this consent, the fee schedule and reward terms, and any changes to them;
- the account agreement, wallet terms, cardholder agreement, privacy notices and other agreements of our licensed partners that you accept when you open an account or apply for a card;
- account statements, transaction receipts, confirmations and histories;
- notices required by law, including notices about errors, unauthorized transactions, disputes, holds, limits, suspension or closure, fee changes and privacy;
- tax documents where we are required to provide them, if you agree to electronic delivery of them when asked;
- responses to your questions, complaints and requests, and any other communication about your account.
2. How we deliver Communications
We may deliver Communications by showing them in the Fintology Financial App or on deposits.fintology.ai (including in your account's Documents or Statements area), by emailing them or a link to them to the email address on your account, by text message to the mobile number on your account where you have agreed to texts, or by any combination. A Communication is considered received by you when we make it available in the App or send it to your email or mobile number, whether or not you open it. You agree to check your email and the App regularly.
3. Electronic signatures
You agree that your electronic signature (ticking a box, tapping a button labeled "I agree", "Accept", "Sign" or similar, typing your name, or any other action we present as a signature) has the same legal effect as a handwritten signature, and that an agreement you accept this way is binding on you under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and applicable state law. We keep a record of what you accepted, when, from which IP address and device, and the version of the document shown to you.
4. What you need
To receive and keep Communications you need:
- a phone, tablet or computer with internet access and a current web browser (the current or previous major version of Safari, Chrome, Edge or Firefox) or the Fintology Financial App on a supported version of iOS or Android;
- a valid email address that you check, and a mobile phone number that can receive text messages;
- software that can open PDF files (most browsers and devices include it), and enough storage, or a printer, to keep copies;
- JavaScript and cookies enabled for the Site and App to work.
If these requirements change in a way that creates a material risk that you could not receive Communications, we will tell you and give you the chance to withdraw your consent without charge.
5. Keeping copies
You can view, download and print Communications from the App or the Site at any time while your account is open, and for a reasonable period after it closes. We recommend you keep your own copies. You may request a paper copy of any Communication by contacting us; we do not currently charge for paper copies, and if we ever do we will tell you the fee first.
6. Keeping your contact details current
You must keep the email address and mobile phone number on your account current, so that Communications reach you. Update them in the App or by contacting us. If an email to you bounces or a text fails, we may hold your account until you confirm a working address or number, and a Communication we tried to deliver is still considered given.
7. Withdrawing your consent
You may withdraw this consent at any time by writing to support@fintology.ai with the subject "Withdraw e-sign consent", by calling +1 (800) 448-1103, or by mail to the address below. Because Fintology Financial is an online service that cannot be provided on paper, withdrawing this consent means we will close your account after you cash out your balance, and we will send you remaining required Communications on paper. Withdrawal does not affect the validity of Communications already provided or agreements already signed electronically. There is no charge for withdrawing.
8. Texts and calls
If you give us your mobile number, you agree that we and our partners may send you account and security texts (one-time codes, transaction alerts, fraud alerts, notices) at that number, and may call you about your account, including with automated or prerecorded messages where the law allows. Message and data rates may apply. You can stop marketing texts by replying STOP; account and security texts continue while you hold an account because they protect it. You can stop account texts by closing your account.
9. Language
Communications are provided in English. If we offer a translation, it is for convenience and the English version governs.
